Court discharges AAP MLA in false education qualifications case

A Delhi court on Friday discharged AAP MLA Bhavna Gaur in a case of allegedly furnishing false details about her educational qualifications in affidavits for the Delhi Assembly polls.

According to sources, Additional Sessions Judge Vikash Dhull passed the order on an plea filed by the politician.

Complaint

Earlier, her application seeking discharge was dismissed by a magisterial court. Thereafter, she had approached the sessions court. The complaint was filed under 125A of Representation of

People's Act (dealing with penalty for filing false affidavit). Complainant Samarendra Nath Verma said that he will approach the higher court against Friday’s order.

Earlier, the court had summoned Ms. Gaur after finding that there were prima facie sufficient grounds to proceed against her. The complaint had alleged discrepancies in details related to educational qualifications in her affidavits filed with the Election Commission in the last two Assembly polls held in December 2013 and February 2015.

The offence under Section 125A of the Act entails a jail term of up to six months or fine or both.

Affidavit

As per the complaint, during the 2013 Assembly polls Ms. Gaur, an MLA from Palam constituency, had mentioned her highest qualification as 12th while during the elections held in 2015, she mentioned her highest educational qualification as BA and B.Ed in her affidavit filed along with her nomination paper.

It is to be noted that Ms. Gaur's degree issue was also raised by expelled AAP leaders Prashant Bhushan and Yogendra Yadav.— PTI
