Court accepts charge-sheet in Uber rape case

A Delhi court on Monday took cognisance of the charge-sheet against the driver of app-based taxi service provider Uber for allegedly raping a 27-year-old working woman in his cab. The victim was on her way back home after dining with her friends on December 5 night.

After taking cognisance of the investigation report, Metropolitan Magistrate Ajay Kumar Malik committed the case to a Sessions court for further proceedings and directed both parties to appear before it on January 7.

“Since the charge-sheet has been filed, copies have been supplied to the accused and the present matter is exclusively triable by the Sessions court, I take cognisance on the charge-sheet and commit the case to the Sessions court for January 7,” Mr. Malik said in his order.

The police had filed the charge-sheet last month under Sections 376 (rape), 366 (kidnapping), 506 (criminal intimidation) and 323 (voluntarily causing hurt) of the Indian Penal Code.

The investigating agency has annexed statements of 44 witnesses in support of the case. They have also submitted a forensic test report of the material evidence to prove the case against 32-year-old accused Shiv Kumar Yadav. The police had arrested him on December 7 in Mathura.

Yadav had refused to undergo the Test Identification Parade during the investigation, saying that the woman had already seen his photograph on Uber’s website and she would identify him.
