Conversion allowed on unregistered agreement

NEW DELHI: The DDA on Wednesday announced its decision to allow conversion of property from leasehold to freehold even on the basis of unregistered agreement to sell.

The rider is that the agreement to sell should be duly stamped after adjudication of stamp duty by the Collector of Stamps.

DDA vice-chairman Balvinder Kumar took the decision considering public demand at an on-going property conversion camp in Rohini.

The decision has been taken after due consultation with the Solicitor General of India and the Legal Department, the DDA said.

It has been explicitly mentioned in the order that in case of any doubt about payment of stamp duty on the given agreement to sell the lease administration officer with the prior approval of the head of department may refer the same to the Collector of Stamps for verification about the payment of the stamp duty.

The DDA said that while processing the conversion applications it was noticed by the different lease administration branches that a substantial number of applications have been filed on the basis of unregistered agreement to sell though they were duly stamped after adjudication of stamp duty by the Collector of Stamps on account of aforesaid statutory provision.

The DDA received demands from such parties that their property be allowed conversion as they have paid the stamp duty.
