‘Contradictions’ highlighted in Uber case

The defence counsel in the Uber rape case on Saturday continued to find fault with the prosecution case.

Resuming his argument before Additional Sessions Judge Kaveri Baweja, D.K. Mishra, counsel for accused Shiv Kumar Yadav, submitted that there was no entry in the daily diary of the Sarai Rohilla police station about either receiving information on the incident or the departure of the investigating officer to the spot. There were also contrary facts regarding who accompanied the IO to the spot, he added.

He also alleged that there was an overwriting over the date in the rukka (report) which was sent to the police station for lodging an FIR in the matter.

He further alleged that there was no mention of injuries to the victim in the report. Also, the constable who had visited the spot, gone to the hospital along with the IO and the victim and taken the report to the police station was not called for recording his evidence in the trial of the case due to these discrepancies.

There was neither mention of lifting of exhibits like sexual assault evidence kit nor about its handing over to the IO in the MLC. There was also overwriting over the address of the victim and on the seal put on the kit.

Mr. Mishra had on Friday alleged that the investigating agency had planted evidence and hidden documents in the case

The prosecution has already completed the final argument, saying that none of the 28 prosecution witnesses have spoken against the prosecution case in their evidence.

The accused had allegedly sexually assaulted the victim at a secluded place after locking the cab while driving her home.
