Consumer forum fines bank for destroying title deeds

The North East District Consumer Disputes Redressal Forum has directed ICICI Bank and Arcil Arms to pay a compensation of Rs 8.50 lakhs to a couple for defacing their original title deeds in lieu of which they had taken a loan. Interestingly, the compensation has been given for a loan amount of Rs 7.08 lakh which the couple repaid in 2007.

The bench of President N.K Goel and Member Nishat Ahmad Alvi said, “The original title deeds of the property of the complainants have been almost destroyed. The complainants may get the certified copies from the office of the sub-registrar.

However, the certified copies cannot be equated with the original documents.”

The couple had moved the forum saying after repaying the loan amount the bank did not return the original documents of one of their properties in Ghaziabad.

When they approached the bank to collect the documents, they found them defaced and completely illegible.

Some of the crucial pages of the documents had also gone missing.

The complainant told the Forum that the bank had transferred the documents to another party, a reconstruction company, without their knowledge and have caused unaccountable loss and that they will not be able to raise any further loan on its basis.
