Both the Congress and BJP have opposed in the Supreme Court the dissolution of Delhi Assembly which is now in suspended animation following the imposition of President’s rule in the State.
Responding to the notice issued by the Court on the writ petition filed by the Aam Aadmi Party challenging the Assembly being kept in suspended animation, the Congress said “It is not desirable and conducive in public interest to hold frequent elections for short durations.” It said the writ petition was not maintainable as whether the assembly could be dissolved or whether it could be kept under suspended animation or whether government formation was possible were not within the scope of judiciary to determine. The party said: “It is for the Lt Governor to decide when to recommend dissolution of the House after assessing the situation.” It wanted the court to dismiss AAP’s petition.
In its response the BJP said “as and when the Lt Governor invites the BJP for consultation whether government formation is possible, appropriate decision will be taken by the appropriate authority in the party. It is for the Lt. Governor to take a call when to dissolve the Assembly. AAP’s petition is nothing but to short circuit the democratic process and it should be dismissed with fine.” The case comes up for hearing on Thursday.
While issuing notice, the court wanted to know whether both the Congress and the BJP could come together to form a legitimate government.
The court observed that nothing was possible in politics. On behalf of the Centre it was submitted that the reason why Assembly was not dissolved and fresh elections had not been called “is because it is possible that the Congress and the BJP may come together to form a government in Delhi.”
