A Delhi court has acquitted a man of sexually assaulting his sister-in-law at his home as the victim as well as her sister and wife of the accused, who had called the police, backed out on their statements in the trial of the case.
The victim stayed along with her sister and her husband, accused Rual Tin Thang, in Uttam Nagar in West Delhi. The victim alleged that she was first time raped by the accused in 2010 when she was alone at her sister’s residence as she had been admitted to a hospital for delivery.
Loud protest
Thereafter, the accused attempted to rape her in 2014. Second time, her sister intervened when she heard her loud protest against the accused’s attempt to sexually assault her. Her sister had then called the police. The police took the three to the police station where she lodged a complaint against her brother-in-law .
The investigating agency had got the victim’s statement recorded under Section 164 of the Criminal Procedure Code before a Metropolitan Magistrate to make it a tight case. The police had also recorded the statement of the victim’s sister.
Deny statements
But in the trial both sisters denied their statements to the police, saying that the accused had not committed rape upon her.
“I do not know how it has been mentioned in the complaint that the accused had raped me in 2010 or that he had attempted to commit rape upon me in 2014. I had told the police officials whatever I mentioned today before this court,’’ the victim told in her evidence .
“Victim’s sister deposed that the prosecutrix had never told her that she was raped by her husband on any day.’’
Observing that since the prosecutrix as well as her sister have not supported the case of the prosecution and there are no other eyewitness to the incident, Additional Sessions Judge Virender Bhat acquitted the accused of the rape charge.
