Complaint against Eswaran

Kongunadu Makkal Desiya Katchi leader and National Democratic Alliance candidate for the Pollachi Lok Sabha constituency E.R. Eswaran has been accused of withholding details in the affidavit filed along with his nomination. However, his nomination was accepted.

Pollachi-based lawyer and Tamil Nadu Kongu Ilaingar Peravai leader M. Paramasivam said that the police had filed two cases against Mr. Eswaran, and a few others in cases relating to conducting a vehicle rally without permission and picking up quarrel with onlookers at Pramathi Police Station in Namakkal.

The police, citing Mr. Eswaran as the first accused, had invoked Sections 143 (unlawful assembly with deadly weapons) and 188 (disobedience to order duly promulgated by public servant) in the first case and 147 (rioting), 148 (rioting with deadly weapons), 323 (voluntarily causing hurt), 324 (voluntarily causing hurt with dangerous weapons), 506 (ii) (criminal intimidation) among others in the second case.

Mr. Paramasivam said that Mr. Eswaran concealing the case details was in contravention of the provisions of The Representation of The People Act, 1951 and therefore his nomination papers ought to be rejected. He submitted a petition in this regard to the Retuning Officer, Pollachi constituency, K. Karpakam.

Mr. Paramasivam said that the election officer concerned had told him that not mentioning the case details alone would not attract rejection.

If he wished to pursue the case further, he could lodge a complaint with the police under provisions of the RPA.

Responding to the allegation, Mr. Eswaran said that his not mentioning the case details was not wilful as he had no idea about the cases.

“The police have not served a summons or warrants on me. Nor have they called me for investigation. In this situation, how am I to know that there are cases pending against me.”
