Justice G. V. Seethapathy of the Andhra Pradesh High Court on Wednesday rejected the plea made by Tim Wright of England to stay the auction of the IPL franchisee Deccan Chargers to be held on Thursday.
The court did not entertain the Civil Revision Petition (CRP) filed by the Englishman through his power of attorney.
It may be recalled that Mr. Wright had filed a case in a London court and claimed Rs.100 crore in damages and this was awarded by the court there. He filed an execution petition (EP) in the Hyderabad court for realisation of the money, based on the decree of the London court. The case is listed for October 3.
Following these developments, Mr. Wright filed a petition seeking a stay on the auction of Deccan Chargers. This application was not entertained by the trial court which asked him to explain how such a petition was maintainable when the main EP had been posted to October 3. Aggrieved by the trial court’s order, he filed the civil revision petition.
Justice Seethapathy said that there was no error on the part of the trial court and dismissed the CRP in the initial stage.
