BMIC case: Deve Gowda files fresh plea in Supreme Court

New Delhi: Former Prime Minister H.D. Deve Gowda on Monday filed a fresh affidavit in the Supreme Court questioning the concessions given by the Karnataka Advocate-General in the court regarding implementation of the Bangalore-Mysore Infrastructure Corridor (BMIC) project as per the 2004 Outline Development Plan (ODP).

Mr. Gowda, who has been impleaded, in the case had already filed his counter for vacating the February 20 order of stay against an interim order of the Karnataka High Court referring his letter addressed to the High Court judges to the Lokayukta for a probe into the BMIC project. In his letter, Mr. Gowda alleged fraud and collusion in the implementation of the BMIC project.

In his fresh affidavit, Mr. Gowda pointed out that on the basis of the concessions made by the Advocate-General, the Supreme Court passed an interim order on November 3 directing the project to be implemented as per the ODP of February 12, 2004 and directed that all decisions regarding the project be taken by a committee headed by Chief Minister of Karnataka and the case was re-fixed for hearing on November 26.

Accordingly, a meeting was held on November 19 under the chairmanship of the Chief Minister and it was decided to implement the project as per the 2004 ODP. Mr. Gowda said that in the light of the submissions made by the Advocate-General it was clear that the Karnataka Government and petitioners NICE Ltd. were trying to mislead this court to pass orders in violation of its own judgment in Somashekhar Reddy case.

Contending that the Advocate-General had misrepresented the court, he said contempt of court proceeding should be initiated against him. Talking to presspersons, Mr. Gowda said his lawyer Prashant Bhushan would make a mention on Tuesday for hearing of the special leave petition pending before a Bench of Justice Jain along with the matter coming up for hearing on November 26 before a Bench of Justice Tarun Chatterjee.
