Plea by Salman Khurshid against a Single Bench order refusing to stay his expulsion from Society The Single Bench had said in its order that no case is made out for grant of injunction NEW DELHI: The Delhi High Court on Monday issued a notice to the DPS Society – which runs the chain of Delhi Public Schools -- on an appeal by Union Minority and Corporate Affairs Minister Salman Khurshid against a Single Bench order refusing to stay his expulsion from the Society. Issuing the notice, a Division Bench of the Court comprising Justice A. P. Shah and Justice S. Muralidhar asked the Society to file a reply to the appeal by December 8. The Single Bench had said in its order that “no case is made out for grant of injunction and prima facie there is no infirmity in the impugned notice dated September 1, 2008” by which Mr. Khurshid was expelled from the Society. However, it had stayed the operation of its order for four weeks and asked the Minister to seek a hearing before the Society within two weeks if he so desired. It had asked the Society to dispose of the representation or complete the hearing if sought by the plaintiff within two weeks thereafter. The Division Bench extended the stay till December 10. Mr. Khurshid had sought the injunction against his expulsion on the ground that the decision to expel him was taken by an improperly constituted working committee of the Society and he was not heard before the decision was taken to expel him. He further submitted that the decision of the Society was mala fide because he had demanded democratisation of the organisation and spoken up against its maladministration.
