BANGALORE: The Karnataka High Court on Monday directed the State Government and managements of private professional educational institutions to refund within two weeks fees collected by them in excess of the fee fixed by the Fee Fixation Committee for undergraduate medical, dental and engineering courses. A Division Bench comprising Justice V. Gopala Gowda and Justice N. Ananda passed the judgment on petitions by managements and students. While the managements had urged the court to permit them to collect fees in excess of what had been fixed by the committee, the students wanted to pay the fees fixed by the committee. The Bench allowed petitions by the students and dismissed petitions by managements of several institutions. The State Government had contended that it had reached a consensus with the managements in 2004 for fee structure for medical, dental, engineering and other professional courses for 2004-05, 2005-06 and 2006-07. According to the agreement, the managements would have to surrender 40 per cent of the total intake to the Government for which a uniform fee would be charged. The managements could charge a higher fee for students coming under the other 60 per cent intake. The students challenged the agreement saying that it was discriminatory and that they too were entitled for a lower fee.
