Kozhikode: The Special Additional District Sessions Court (Marad cases) has exonerated five persons from all charges in a case of looting and setting a house ablaze during the communal clashes at the seaside village of Marad in January 2002. Writing the judgment here on Tuesday, special judge K.P. Prasannakumari acquitted Rafeek, Zakeer, Basheer, Noufal and Faizal, all hailing from Marad, in the case of looting and setting on fire the house of Jeejabhai on January 3, 2002. The accused had decamped 12 sovereigns of gold and Rs.8,000 and destroyed property worth Rs.1 lakh, according to the prosecution. The Beypore police had charged the accused under Section 436 (mischief by fire or explosives with intent to destroy house), Section 450 (house trespass in order to commit offence punishable with death), Section 153-A (promoting enmity between groups on the grounds of religion, race, place of birth, residence and language and doing acts prejudicial to maintenance of harmony), Section 143 (unlawful assembly) and Section 148 (rioting, armed with deadly weapons) of the Indian Penal Code (IPC). This is the tenth of the 67 cases registered in connection with the incidents including the five murders on the Marad beach on January 3 and 4. The court said that the prosecution had failed to prove the charges against the accused. P.D. Ravi appeared for the prosecution and P.K Varghese and M.T. Shameer appeared for the accused.
