Ruling on impounding of passport

Kochi: The Kerala High Court on Thursday held that a munsiff court could not pass an order impounding a passport of a debtor on an execution petition. Justice S.S. Satheesachandran, while disposing of a petition challenging the impounding order of a munsiff court, observed that when a holder of the passport or travelling documents was convicted in a criminal offence, the court which had convicted him or the appellate court could only order impounding of his or her passport. No other court could pass such an order.
