Trial: Telgi’s plea to court

BANGALORE: Abdul Kareem Telgi has requested the Special Court here that he should not be tried in each of the pending stamp paper racket cases when he has been already convicted on similar facts.

He has filed this application in the cases registered in the Upparpet and Madiwala police stations.

Telgi and 12 of his associates were arrested in connection with recovery of Rs. 53.12 lakh fake stamp papers in Upparpet police station limits in August 2000 while the Madiwala case is related to the charge against Telgi of continuing with the fake stamp paper business even after being lodged in the Bangalore Central Prison.

In his application filed under Section 300 of the Criminal Procedure Code, Telgi has said a person who has been tried once cannot be tried further on similar set of facts.

He has made a mention of the imprisonment of 13 years awarded by the Special Court for MCOCA (Maharashtra Control of Organised Crime Act) cases and convictions awarded by courts in Tamil Nadu, New Delhi and Ahmedabad.

He has also mentioned about convictions awarded by Bangalore Special Court in four cases.

“We have brought to the notice of the court the sentence awarded on Friday, which is the fifth case in Karnataka where Telgi has been convicted,” said Telgi’s counsel M.T. Nanaiah. Central Bureau of Investigation’s Senior Special Prosecutor B.R. Nanjundaiah will submit his arguments against the application on Saturday.
