New Delhi: A Delhi court on Saturday refused bail to a man who was arrested on the charge of being an Al-Badr militant but later given clean chit by the CBI. Additional Sessions Judge S.K. Gautam refused to provide any relief to Irshad Ali who was arrested along with Moarif Qamar in February 2006 by the Delhi Police’s Special Cell. Sufian Siddiqui, counsel for Ali, sought bail for him on the ground that since the court had earlier held that facts in the case brought out a mixed picture, the benefits of doubt should be given to the accused as has been laid down by the Supreme Court. Plea opposedThe Special Cell, however, opposed his plea on the ground that the accused was in constant touch with his handlers in Pakistan, which was also revealed by his mobile call records. The court had on February 13 refused to discharge both the accused saying “facts are mixed, no definite conclusion can be drawn on the CBI’s closure report.” The Special Cell, which arrested Qamar and Ali with help of an IB official terming them as Al-Badr militants allegedly carrying RDX, timer devices and two Chinese pistols, was left embarrassed after the CBI following an inquiry in November last year found nothing against the two and termed them as “innocent”. -- PTI
