Disclose documents on Batla House encounter: CIC

Name, details of those involved in the probe not to be revealed


Delhi police had earlier rejected an RTI plea in this regard

Application filed by lawyer representing Delhi blasts accused


NEW DELHI: In a setback to the Delhi police, the Central Information Commissioner (CIC) on Monday directed them to provide documents pertaining to the Batla House encounter to a Right to Information applicant but asked them not to reveal names and details of those involved in the probe.

The applicant, a lawyer representing an accused in the Delhi serial blasts of September 13 last year, had filed the RTI application seeking the FIR details and post-mortem reports of those killed during the blasts.

The CIC allowed the police to expunge the person’s name who filed the FIR, details of the police officers involved in the encounter and subsequent probe and doctors who conducted the post-mortem on the persons killed during the incident as that could impede the investigations.

Senior advocate Prashant Bhushan, representing an accused in the Delhi serial blasts case, had demanded copies of the FIR and post-mortem reports of Inspector M. C. Sharma and suspected terrorists Mohammad Atif Amin and Sajid, killed during the encounter which took place in South Delhi on Sept. 19.

The Delhi police had rejected the RTI application claiming that the matter was under investigation and revelation of these crucial documents would impede the probe.

“....The Delhi police will provide copies of the documents sought by appellant....after applying severability clause described above to that portion held as exempt, within 10 working days,” a two-member Bench comprising Chief Information Commissioner Wajahat Habibullah and Information Commissioner Shailesh Gandhi held. – PTI
