NEW DELHI: The Supreme Court has issued notice to the Bihar Government on a special leave petition filed by Janata Dal (United) MLA Sunil Kumar Pandey challenging the sentence of three months’ imprisonment imposed on him by the Patna High Court for criminal contempt. A bench of Justice B. N. Agrawal and Justice J. M. Panchal issued the notice after hearing the MLA’s counsel Samir Ali Khan who questioned the manner of the conviction. The Patna High Court had sentenced the MLA from Piro to three months’ imprisonment after he, allegedly in a drunken state, abused a Sub-Divisional Judicial Magistrate of Bikram, on April 25, 2007. ‘Abused judge’It was alleged that Mr. Pandey was allowed to consume liquor by the escort police when he was being taken to the judge in connection with a kidnapping case pending against him. The MLA was said to have entered the judge’s chamber and abused him before being whisked away by the police. On the basis of a complaint from the judge, the Patna High Court initiated contempt proceedings and held the MLA guilty. He was awarded a punishment of three months’ imprisonment on September 10 this year.
