Court sets aside TNEB circular

CHENNAI: The Madras High Court has set aside a circular issued by the Tamil Nadu Electricity Board in June this year, specifying certain criteria for high tension tariff concession.

In his order on a batch of writ petitions, Justice K. Chandru said the June 10 circular could not act as a guideline. On the contrary, it was a wrong interpretation of a Supreme Court’s decision, and it prevented the authorities from deciding the claims of consumers on their own merits.

The petitioners’ grievance in most of the writ petitions was that subsequent to a judgment of the Supreme Court in May this year in a case involving the TNEB, the Board issued a circular, which they said was not only uncalled for, but also contrary to the directions issued by the Supreme Court. Besides the circular issued by the Chief Engineer (Commercial) on behalf of the Board Chairman, several individual orders passed by the Board pursuant to the Supreme Court’s order were challenged. The government granted some tariff concessions to various consumers with effect from February 1995. However, through a Govt Order, the concession in respect of high-tension tariff was sought to be withdrawn from February 15, 1997.
