Response of Centre, States sought

New Delhi: The Supreme Court on Wednesday sought the response of the Centre and the States on the report of a Task Force recommending that a judicial impact assessment (JIA) be done whenever a law is introduced in Parliament or the State legislatures.
The report of the Task Force headed by Justice M. Jagannadha Rao, former Law Commission Chairman, was earlier submitted before a Bench of Justice B.N. Agrawal and Justice G.S. Singhvi. The court had appointed the Task Force on a writ petition filed by Salem Bar Association.
The report said: “The budget must mention the number of cases likely to be generated by the new Act, how many courts and how many judges are necessary. JIA must be made on a scientific basis to assess the extra case-load which any new Bill or legislation may add to the burden of courts, and the expenditure required for adjudication of such cases must be estimated by the government and adequate budgetary provision made therefor.”
Appearing as amicus curiae, Counsel K.V. Viswanathan submitted that the Task Force had suggested the setting up of judicial impact offices in Delhi and the States.
