State defends reservations for Muslims

HYDERABAD: Hair-splitting arguments and microscopic analysis may not be the basis for striking down social welfare legislation, Advocate General C.V. Mohan Reddy contended before a Seven-Judge Bench of the High Court on Tuesday while defending the action of the State government in providing reservations for selected Muslim castes.
The Bench comprises Chief Justice Anil Ramesh Dave, Justice T. Meena Kumari, Justice B. Prakasha Rao, Justice D.S.R.Varma, Justice A. Gopala Reddy, Justice V. Eswariah and Justice Goda Raghu Ram. A batch of writ petitions were filed challenging the constitutional validity of the action of the State government in providing reservations in fields of public employment and education for certain sections of Muslims.
The Advocate General drew the attention of the court that if there is some material available and if that material can satisfy a prudent man to come to the conclusion that some sections are socially and economically backward, deeper analysis and in-depth scrutiny may not be permitted. He averred that the allegations about the scientific precession of the data; analysis, etc., should not be the ground for striking down an Act.
The arguments will be continued on Thursday.
