BANGALORE: The Karnataka High Court on Monday directed the State Government, the Karnataka Industrial Areas Development Board (KIADB) and Nandi Infrastructure Corridor Enterprise (NICE) to maintain status quo on development of land at Konena Agrahara in Bangalore. A Division Bench comprising Justice K. Sreedhar Rao and Justice C.R. Kumaraswamy passed the order on appeals by V. Krishnamurthy and others against a trial court order of February 8, 2008. A trial court in Bangalore had said that the State Government had the right to acquire and lease land belonging to Mr. Krishnamurthy and others in Konena Agraha to NICE for the Bangalore-Mysore Infrastructure Corridor project. Mr. Krishnamuthy had filed an appeal against the lower court order and sought status quo on further development of the land. In his appeal, he said his ancestors owned 308 acres of land in Konena Agrahara, Begur hobli, Bangalore South. He said as water was needed for cultivating the lands, his grandfather, Govinda Chetty had constructed a lake on 28.10 acres of land. The lake is now called Govinda Chetty lake. He said in 1993-94, their names came to be removed from the revenue records (RTC). This was challenged before the jurisdictional Tahsildar, Assistant Commissioner and Deputy Commissioner. Subsequently, a writ petition also came to be filed. He said the writ petition was disposed of with a direction to the civil (trial) court to pass orders independently without being influenced by the orders of the Tahsildar, AC or DC or revenue authorities. He said the trial court had passed an erroneous order, holding that the land in Konena Agrahara belonged to the Government and that it could lease it to any party. He urged the court to set aside the trial court order. The court ordered status quo of the lands and adjourned further hearing of the case.
