Land dispute: High Court dismisses anticipatory bail plea of three persons

CHENNAI: The Madras High Court has dismissed anticipatory bail applications of a Sub-Registrar and another person in alleged incidents relating to a land dispute within the Perundurai police station limits in Erode district in July this year. The court also dismissed the bail plea of another person, a document writer.

The prosecution case was that Guhamani and his brother P.C. Palanisamy owned about 10 acres and a property. N.K.K.P. Raja, who was a Minister then, forced them to attend the `panchayat’ in an attempt to grab the property.

When they refused, armed gang trespassed into the house of Mr. Palanisamy, broke open the door, kidnapped Mr. Palanisamy, his wife Malarvizhi and son Sivabalan, and confined them. They were further threatened over phone to sign documents and their signatures were obtained on blank stamp papers. A partition document was registered in favour of some of the accused.

Two days later, several persons looted the household articles, jewellery and documents and uprooted coconut trees from the place of occurrence and fenced the land. Two cases were registered in connection with the incidents.

Following habeas corpus petitions, the detenus, Mr. Palanisamy, Ms. Malarvizhi, Mr. Sivabalan and Mr. Guhamani, were released from illegal custody.

Government Advocate (Criminal side), A. Saravanan submitted that in both the cases, investigation was in a crucial stage.

In his order, Justice T. Sudanthiram said the anticipatory bail application filed by 21 other accused had already been dismissed by the High Court after elaborately discussing the facts. Investigation of the cases by the CB CID was in a crucial stage. The statements of witnesses and victims implicated all the petitioners -- Anbalagan, the Sub-Registrar; Mahalingam, who purchased the disputed property; and Karunakaran, document writer.
