Kochi: The Kerala High Court, on Monday, held that a man was entitled to claim compensation separately for the loss of child in accident claim cases involving the death of his pregnant wife. A Division Bench, comprising Justice C.N. Ramachandran Nair and Justice Harun-Ul-Rashid, said the compensation to be granted for the death of a pregnant woman was for the loss of two lives. The court observed that the loss of foetus was actually the loss of the child in the offing for the man. T.R. Manikuttan of Thodupuzha and his mother-in-law filed an appeal seeking to enhance the compensation awarded by the Motor Accident Claims Tribunal.
