High Court dismisses petition

MADURAI: The Madras High Court Bench here on Monday dismissed a petition filed by a Special Deputy Collector at Nagercoil in Kanyakumari district to transfer an attempt to murder case registered against Tourism Minister N. Suresh Rajan to the Central Bureau of Investigation.

Justice K.N. Basha agreed with the State Public Prosecutor Raja Elango that there was no reason to transfer the case when the local police had completed the investigation within three months, as directed by the court, and also filed a charge sheet before the lower court.

On the petitioner’s contention that the name of the Minister and a few other accused had been excluded in the charge sheet, the Judge said that there were sufficient provisions in the Criminal Procedure Code to include any person if the trial court found credible evidence against him before pronouncing the judgment.

Petitioner S. Janarthanan (57) had alleged that the Minister abused him in public by referring to his caste at a function to distribute free colour television sets at Vadaseri in Kanyakumari district on April 18 and also instigated two advocates to assault him, owing to previous enmity.

“The Chief Minister had openly given a statement to the press and news media stating that no prima facie case has been made against A1 Suresh Rajan. I submit that the above statement will prejudice the investigation and the State police will try to strengthen the above statement,” his affidavit stated.
