Takeover of temples: court grants interim stay

CHENNAI : The Madras High Court has granted interim stay for 12 weeks on proceedings pursuant to an order of the HR and CE Board, stating that the board had taken over the administration of the Arulmigu Kasi Visvanathar Alayam and Lakshmi Narasimha Perumal Thirukoil in Kadapakkam village in Cheyyur taluk of Kancheepuram district.
In his writ petition, N.Samantha Murthi Mudaliar, trustee, submitted that the temple was constructed by his forefathers and the domicile area people in 1903. It was located on 1.37 acres. It consisted of the two temples and a tank situated in between them. The temple had historical importance.
Till date, the temple was administered by the domicile villagers, who contributed to the daily functioning and for performing poojas and payment of salary to the priest. There was smooth functioning of the temple by the present trustees and the villages.
By the impugned order dated October 6, the Assistant Commissioner, HR and CE Board, Kancheepuram, had requested the trustees to hand over the administration immediately. The board had directed the appointed executive officer to file a report on the management and the property of the temple.
The petitioner said the impugned order violated principles of natural justice. The Assistant Commissioner had not assigned any reason for taking over the administration of the temple and appointing the Executive Officer.
The petitioner prayed the court to call for the records relating to the Assistant Commissioner’s proceedings and quash the same.
