BANGALORE: The Karnataka High Court on Monday stayed the acquisition of land at Sora Hunse village in Varthur, Bangalore East, for the Peripheral Ring Road (PRR) project. Justice S. Abdul Nazir passed the order on a petition by G. Krishnappa, who had challenged the acquisition of his land by the Bangalore Development Authority (BDA) for the project. In his petition, Krishnappa said the BDA came up with a Comprehensive Development Plan (CDP) in 1995 and that it was supposed to be valid till 2011. However, on April 18, 2004, the BDA proposed a draft master plan and submitted it to the Government. This was published in 2005, inviting objections and suggestions from the public. He said the BDA issued preliminary and final notifications for acquiring his land for the PRR project. He said the notifications are ultra vires as they violate Article 14 of the Constitution. Moreover, the BDA had not provided any details to the Government on the PRR project. He urged the court to stay the notifications acquiring 3.31 acres of his land at Sora Hunse village. DirectedA Division Bench comprising Chief Justice P.D. Dinakaran and Justice V.G. Sabhahit on Monday directed the State Government to produce proceedings relating to cancellation of grant of land given to some persons in Giddadakonenahalli in Yeshwanthpur, Bangalore.
