Change in Tamil New Year: High Court orders notice

CHENNAI: The Madras High Court on Friday ordered notice on a writ petition challenging the State Government’s legislation declaring that hereinafter instead of the first of Chitrai month, the first of “Thai” will be Tamil New Year Day and the first Tamil month would be “Thai”, instead of “Chitrai”.

When the petition came up before the First Bench comprising the Chief Justice A.K.Ganguly and Justice F.M.Ibrahim Kalifulla, the government pleader (GP) took notice. The Bench said a notice be served on the Advocate-General also. The GP may file an affidavit two weeks after the Pooja vacation. Rejoinder, if any, to be filed by one week thereafter. The case may be posted three weeks thereafter, the Bench said.

In his public interest litigation petition, K.R.Ramaswamy alias Traffic Ramaswamy, founder Chairman, TANSWO, said the legislation was unconstitutional and ultra vires since the State legislature lacked competence to enact it. The petitioner said that from time immemorial, the first day of Chitrai was regarded as Tamil New Year Day by Tamils. The present government’s move was wholly contrary to the Tamil calendar being followed for over 2000 years. The celebration of first day of Chitrai as new year day was a matter of faith of Tamils, their culture and their religion. It was not open to the government to change the calendar. The government had several things to do as contained under the “Directive Principles of the State Policy.” Nothing had been done with regard to many of these provisions .

The petitioner prayed the court to declare the legislation as unconstitutional and ultra vires of Articles 14, 25, 26 and 29 of the Constitution.
