Centre to file affidavit on SIMI role in bombings

New Delhi: The Supreme Court will hear on August 25 the Centre’s petition seeking extension of the stay on a tribunal order quashing the notification declaring the Students Islamic Movement of India an unlawful organisation.

The Special Tribunal was set up under the Unlawful Activities (Prevention) Act.

A Bench, consisting of Justices B.N. Agrawal, H.S. Bedi and G.S. Singhvi, fixed the date on a mention made by Additional Solicitor-General Gopal Subramaniam on Tuesday that the special leave petition against the lifting of the ban on the SIMI had not been listed and that the three-week stay was due to expire on August 27.

The Centre will file on Wednesday an additional affidavit on the involvement of SIMI cadres in the recent bomb incidents in Ahmedabad and Surat.

On August 6, a Bench headed by Chief Justice K.G. Balakrishnan, while staying the tribunal order, ordered notice to the SIMI seeking its response. Though the matter was scheduled for further hearing on August 22, it was not listed that day. Hence the Additional Solicitor-General made the mention for listing the petition, stating non-extension of the stay would have serious consequences.
