High Court directive to TNPSC

CHENNAI: The Madras High Court on Thursday directed the Tamil Nadu Public Service Commission (TNPSC) to permit 32 persons to write Group-I services main examinations scheduled to be held on August 16 and 17, along with 1750 candidates already found eligible to write the exam.

S. Senthil Kumar and others filed writ petitions seeking a direction to the TNPSC to treat them as having passed the Group-I services preliminary examination 2006-07. It was their specific case that the marks awarded to them was lesser than expected due to the wrong key answers given for some questions, wrong questions asked and more than one answer was correct for certain questions. They said the commission should have rectified the discrepancies in the questions/answers and proceeded with the valuation. Marks should have been awarded to those who attended such questions.

In his order, Justice N. Paul Vasanthakumar directed the petitioners to submit a representation by August 7 pointing out the number of questions which were not correctly asked and which had more than one correct answer. They should also point out whether the key answers to questions were correctly given.

The TNPSC should place the disputed questions before the Expert Committee to be constituted by it for verification. After verification, the committee should award marks to such of those petitioners who attempted the said questions and on that basis determine the final marks of the petitioners in the preliminary examination. Since the above said exercise would take some time and in view of the date having been fixed for the main examination, the TNPSC should permit the petitioners also to write the main exam.

If the petitioners get the required cut-off marks prescribed for the respective category, their main exam papers should be valued. If they do not, their answer papers need not be valued. The Judge said the benefit of the court order was restricted to the writ petitioners.
