Petition on Civil Judge recruitment admitted

MADURAI: The Madras High Court Bench here on Wednesday admitted a writ petition filed by a physically challenged lawyer alleging non-adherence to the quota for physically challenged in the recruitment of District Munsifs and Judicial Magistrates. A Division Bench of Justice Elipe Dharma Rao and Justice M. Venugopal ordered notice returnable by two weeks to the Home Secretary and the Secretary as well as Controller of Examinations of the Tamil Nadu Public Service Commission

P. Kumaran, a gold medallist in Master of Law (1997), said that he applied for the post of Civil Judge (junior division), which comprises Munsifs and Magistrates, pursuant to a recruitment notification issued in 2003 for 110 vacancies. He sought a job under the physically challenged quota as he was afflicted with polio.

The petitioner claimed that he secured the seventieth place with 251 out of 300 marks in the written examinations and also attended the subsequent interview. But he was not selected for the post. On the other hand, nine women candidates, who had scored below 250 marks, were appointed to the post, he alleged.

Pointing out that the TNPSC had included his name in the Reserve List which would be in force until the next selection process and entitle him to be selected in the event of any selected candidates failing to join duty, the petitioner sought a direction to allot one post for him in the ongoing recruitment of 201 Civil Judges pursuant to a notification issued in The Hindu on May 10.

The petitioner also sought a direction to release his name from the Reserve List and to appoint him as a Civil Judge, under three per cent quota earmarked for physically challenged candidates.
