Probe against Punjab Vigilance chief stayed

NEW DELHI: The Supreme Court has stayed all further investigation by the Central Bureau of Investigation against Punjab Vigilance Director S. S. Saini in a criminal case registered against him at the instance of the Punjab and Haryana High Court.

A three-Judge Bench of Chief Justice K. G. Balakrishnan, Justice P. Sathasivam and Justice J. M. Panchal stayed the investigation on a special leave petition filed by the Punjab Government challenging the High Court order. The Bench, after hearing senior counsel Harish Salve for the State, issued notice to the respondents, including the CBI.

Mr. Salve submitted that the High Court had passed an order directing a CBI investigation in respect of an offence alleged to have taken place in the State 17 years ago.

He said the High Court had re-opened matters that had been disposed of and no notice was issued to the State before the order was passed.

In its special leave petition, the Punjab Government said the order had been passed by the High Court in the most unusual circumstances.

The manner in which the entire matter had been dealt with had cast serious aspersions on the police force and resulted in an unusual FIR registered against one of the senior-most officers of the State, he added.

It said the State was extremely concerned over the turn of events in which decorated police officers who had been instrumental in the fight against terrorism were now at the receiving end of criminal investigation at the instance of proclaimed offenders and those convicted for serious criminal offences.
