MCD to withdraw pending cases against shopkeepers

NEW DELHI: The Municipal Corporation of Delhi will now withdraw prosecution cases pending in various courts against shopkeepers for misuse of their premises.

MCD Standing Committee Chairman Vijender Gupta said on Tuesday that this act of pardon would benefit over 5,000 shopkeepers.

“Section 347 of the DMC Act states that no person shall, without the written permission of the Commissioner, use or permit to be used for human habitation any part of a building not originally erected or authorised for that purpose. The Act also forbids change of the use of any land or building,” he said, adding that in view of this provision the civic body had lodged First Information Reports against traders for misuse and violation and these cases were pending in various courts.

“But Master Plan for Delhi-2021 has permitted such usage on notified mixed land use roads, special areas as well for permitted shops of 24 categories being run in premises up to 20 square metres. Hence in the upcoming meeting of the Standing Committee the Municipal Commissioner would be directed to withdraw these pending cases for misuse of premises. This Act would save over 5,000 traders who are presently facing prosecutions,” he clarified.
