Norms for probe into incest sought
New Delhi: The Delhi Commission for Women (DCW) on Monday moved a PIL before High Court seeking direction to the NCT government to issue guidelines to the police on investigation into cases where children are raped by their own family members.
Issuing a notice to Commissioner of Police, a Division Bench of Chief Justices A.P. Shah and S. Muralidhar sought a reply by July 9 on the DCW’s petition pointing to the high acquittal rate in such cases.
High acquittal rate
The Commission alleged that in such case, also known as incest, the acquittal rate was high due to lack of guidelines and the limitations faced by the police while collecting evidence in such cases. Citing a rape case where the trial court had acquitted an accused, Lalit Pandey, of charges of raping his four-and-half-year-old daughter due to retraction by her mother and elder sister, the DCW counsel Aparna Bhat submitted that this court should also issue guidelines for the trial courts so as to strictly deal with such type of cases. — PTI
