“Liability more for larger vehicle”
New Delhi: In an accident where both the vehicles are at fault, the liability to compensate lies more with the bigger one, an Accident Claims Tribunal has ruled.
In such cases, “blameworthiness” should be made out as per the horse power, Motor Accident Claims Tribunal Judge A.S. Jayachandra held.
“The vehicle with higher horse power should not escape the major part of the blameworthiness.” He directed an insurance company to pay Rs.6.57 lakh to the family of a young boy who died in an accident involving an insured car last year. — PTI
