Coimbatore: The Coimbatore Consumer Cause (CCC) has urged the Chief Minister to ensure that the State Government file a review petition before the Supreme Court for continuing the ban on registration of documents opposed to public policy.
The Government through an order number 139 dated July 25, 2007 of the Commercial Taxes and Registration Department cancelled its earlier notification and revoked its GO number 150 of September 22, 2000, wherein a ban was imposed on registration of documents opposed to public policy. The orders for revoking the earlier GO and for cancellation of earlier notification were based on the recent judgment of the Supreme Court.
The revoking of the ban would adversely affect the interests of the public as well as the Government, secretary of CCC Kathirmathiyon pointed out. He recalled the recent incidents of innocent people getting cheated after they bought unapproved sites. At that time, many people appealed to the Government that the department should have been directed to stop registration of sites in unapproved layouts. Cancellation of sale deeds without the express consent of the parties to the documents was also banned.
The cancellation of the earlier notification would result in the Government being forced to face problems in respect of the future unapproved layouts and would be under tremendous pressure to provide all facilities to those layouts as well.
More than that cancellation of the notification would result in the seller of a property cancelling the sale deed on his own without the knowledge of the buyer and would lead to many frauds resulting in litigations.
The Government needs to issue specific order in the matter. The CCC urged the Chief Minister to take steps so that the State Government could file a review petition before the apex court.
