MADURAI: The Madurai Bench of the Madras High Court on Tuesday refused to stay its direction to the State Government to provide food and shelter to 22 convicts in the Imam Ali escape case.
Dismissing a petition filed by the Government, Justice P. Murgesen said there was no provision under the Criminal Procedure Code to stay an order passed by the same court.
The Judge agreed with senior counsel K. Thirumalai Raj that the Supreme Court too had held that the High Courts were not empowered to revise their orders.
A Fast Track Court here convicted more than 30 persons in the Imam Ali escape case in January this year. They were sentenced to undergo imprisonment between five and seven years. Nearly 25 of them filed an appeal against the conviction before the Madurai Bench.
The Bench, in May, enlarged them on bail on the condition that they stayed in Chennai and reported to the police twice a day. The convicts filed a petition seeking relaxation of the conditions.
