Doctor couple’s son seeks anticipatory bail

MADURAI: A 16-year-old school student from Manapparai in Tiruchi district, accused of performing a Caesarean section , has filed an anticipatory bail petition before the Madurai Bench of the Madras High Court.

Justice G. Rajasuria on Thursday directed the government advocate to obtain instructions from the police before adjourning the matter to Friday.

The prosecution case was that the petitioner’s doctor parents, K. Murugesan and M. Gandhimathi, encouraged him to perform the Caesarean section on an expectant mother on March 25.

The procedure was recorded on video and screened at a meeting of the Indian Medical Association on May 6.

Immediately after the issue came to light, the police registered a case against all the three under Sections 308 (attempt to commit culpable homicide), 336 (act endangering life of others), 338 (causing grievous hurt by act endangering life), 417 (cheating), 419 (cheating by personation), 468 (forgery for the purpose of cheating) and 201 (causing disappearance of evidence) of the Indian Penal Code and other provisions of the Indian Medical Council Act.

Denies allegations

While the parents were arrested and remanded to judicial custody, the student was still at large.

In his petition before the Bench, the boy denied all allegations levelled against him and claimed he was falsely implicated in the case.
