Court allows Balli to attend session
Legal Correspondent
New Delhi:
The Supreme Court on Friday permitted BJP legislator Harsharan Singh Balli, sentenced to three-month imprisonment for contempt of court, to attend the Delhi Assembly session any particular day on condition that he be taken back to the jail after the proceedings.
A Bench consisting of Justices Arijit Pasayat, C.K. Thakker and L.S. Panta granted permission following a letter by the Deputy Secretary, Legislative Assembly (on behalf of Speaker Choudhary Prem Singh) sent along with a request from leader of the Opposition Jagdish Mukhi.
Mr. Balli would be allowed to attend the session only the day for which he makes a request to jail authorities. Earlier, amicus curiae Ranjit Kumar said no leniency should be shown to Mr. Balli, who had stated that defying a court order was part of his legislative duties. On April 10, Mr. Balli confessed before the Bench that he broke open 22 seals on commercial premises in Raja Garden here sealed pursuant to the court directions. As he justified his action saying he owed a public duty to do so, the court awarded him three-month imprisonment. The same day he was lodged in Tihar jail.
