Kauriram byelection on March 25

NEW DELHI: The Election Commission on Saturday announced that the byelection to the Kauriram Assembly constituency in Uttar Pradesh would be held on March 25.

The election of Ram Buhal of the Bahujan Samaj Party who was elected from the constituency was declared void by the Allahabad High Court on October 28, 2004.

This order was challenged by Mr. Buhal in the Supreme Court, which on November 22 granted an interim stay and permitted him to attend the meeting of the Assembly, pending final disposal of the appeal.

In a press note, the Commission said that on September 29 the apex court had dismissed the appeal and confirmed the decision of the High Court and vacated the interim stay order.

Clear vacancy

Although Mr. Buhal had in a letter written on November 22 last year to the U.P. Assembly Speaker, and sent a copy to the Commission, mentioned that he had filed a review petition against the Supreme Court judgment, no further order/direction has been brought to the notice of the Commission so far, the press note said adding that therefore a clear vacancy has arisen.

As per the schedule announced by the Commission, March 8 would be the last date for filing of nominations and counting of votes would be taken up on March 27.

Identification must

Electronic Voting Machines would be used in the byelection and voter identification would be mandatory. The model code of conduct shall come into force with immediate effect in the districts in which the constituency falls.
