Plea on DUTA results dismissed

NEW DELHI: The Delhi High Court has dismissed an appeal by S.D. Siddiqui, who had lost to Amar Deo Sharma in the Delhi University Teachers' Association (DUTA) elections held on August 31 this year, "saying that the University is not a State under Section 12 of the Constitution".

Dismissing the appeal, a Division Bench comprising Justice M. Katju and Justice Madan B. Lokur said a writ does not lie if the respondent is not a State or part thereof under Section 12 of the Constitution.

Mr. Siddiqui had filed the appeal against the judgment of Justice Vikramjit Sen who had dismissed his petition challenging the election of Mr. Sharma.

Justice Sen had said that no irregularities were committed in the counting of the votes as alleged by the petitioner.
