NEW DELHI: A Delhi court has acquitted an accused in an extortion case saying that the prosecution had failed to establish its case against the accused beyond all reasonable doubts. Acquitting accused Inderjeet, Metropolitan Magistrate Kanwal Jeet Arora said: "So far as the incident is concerned, the same, as per the prosecution witness and complainant in the case, Kamlesh Sharda, had taken place in the presence of two independent witnesses, which fact has been denied by them during the course of their deposition.'' "Therefore, the prosecution has failed to establish its case against the accused beyond all reasonable doubts. Further, the deposition of the complainant also appears to be untrustworthy, as it seems implausible as to why the accused was not apprehended by the complainant at the spot itself when, as per the complainant, he came to his office, more particularly when five-six employees of the complainant were present at his office, as deposed by him during his statement in the court,'' the Magistrate said. "Having regard to these facts and circumstances, I am of the considered opinion that the prosecution has failed to bring home the charges framed against the accused beyond all reasonable doubts,'' the Magistrate added. On a complaint by Kamesh Sharda, a businessman, the Punjabi Bagh police had registered the case. Mehta had alleged that Inderjeet used to extort money from him by threatening to implicate him in criminal cases.
