High Court summons trial court record in Katara case

NEW DELHI: The Delhi High Court on Monday sent for the Nitish Katara murder case file from the trial court to know why a public prosecutor (PP) of the Delhi Government appeared in the case when the crime was committed in Uttar Pradesh.

Justice H.R. Malhotra summoned the file when counsel for Vikas Yadav, the main accused in the case, argued for deletion of the mentioning of the Delhi Government as an respondent in a petition of Neelam Katara, mother of Nitish Katara, saying the that the Delhi Government PP had no locus to appear in the case as the cause of action was in Uttar Pradesh.

Mr. Justice Malhotra was hearing the petition by Ms. Katara challenging the dropping of Ms. Bharti Yadav, sister of Vikas Yadav and daughter of the former Rajya Sabha Member, D.P. Yadav, as a prosecution witness in the case. Vikas Yadav sought deletion of the mentioning of the Delhi Government as a respondent in the petition of Ms. Katara on the above-mentioned ground.

Mr. Justice Malhotra this past April stayed the trial proceedings in the case on Ms. Katara's petition.
