Court reserves orders on TN MLA's plea

BANGALORE, JULY 14. The Karnataka High Court on Wednesday reserved orders on an appeal by the Tamil Nadu MLA, Selvi Murugeshan, and two others, challenging a trial court order of June 26 asking them to undergo the narco-analysis test.

The appellants, Selvi Murugeshan, her husband, T.A. Murugeshan, and S. Govindaraj, all from Tamil Nadu, contested the lower court order and said it had exceeded its jurisdiction by permitting the Bangalore police to conduct narco-analysis test on them.

Selvi Murugeshan, Murugeshan, Govindaraj, Kumar, Dhadiya and Bengal were arrested by the Koramangala police under Sections 302, 365 and 120-B of the IPC.

The Attibele police had found a body on the premises of factory, and it was identified as that of Shivakumar, son-in-law of Selvi Murugeshan (Shivakumar had married Kavita, Selvi Murugeshan's daughter.) Shivakumar and Ms. Kavita were living in Bangalore as her parents had disapproved of the marriage. Shivakumar was kidnapped and his body was found the next day.

Ms. Kavita lodged a complaint with the Koramangala police accusing her parents of having kidnapped her husband.

The Koramangala police arrested Selvi Murugeshan and others on charges of murdering Shivakumar.

When the accused were produced before the Sessions Court, they were ordered to undergo brain-mapping and serum tests.

They said the test reports did not incriminate them in the offences for which they were arrested. They said they were shocked when the police filed another application before the Sessions Court seeking permission to conduct the narco-analysis test.

The court directed Selvi Murugeshan, Murugeshan and Govindaraj to undergo the narco-analysis test.

Justice S.B. Majage reserved orders on their plea against the trial court directive.
