Central Act to State's rescue

Bangalore June 25. The recently adopted Electricity Act of 2003 (Central Act) has come in handy for the State Government to suspend some sections related to the term of office of the Chairman and members of the Karnataka Electricity Regulatory Commission. The action will have a bearing on the tenure of the two persons who have to be appointed members of the commission. The Government has issued an order suspending three sections (84, 85, and 89 of the Central Act) for a period of six months. While one of the members, H.R.Gopal has retired, another member, Nalini M.K.Menon, is due to retire at the end of the month. Under both the Central Electricity Act and the Karnataka Electricity Reform Act of 1999 (under which the commission has been formed), the chairman and the members hold office for a term of five years or until the age of 65 years. The State governments have power under Section 172 of the Central Act to declare that any or all the provisions of the Act shall not apply for a period not exceeding six months.
