In the wake of a Supreme Court order, the Government has issued a notification under the Tamil Nadu Industrial Employment (Standing Orders) Rules 1947. It has amended the MSO framed under the Industrial Employment (Standing Orders) Act to include sexual harassment of women at workplace a misconduct. In the `Vishaka case', the apex court held in August 1997 that it was necessary and expedient for employers at workplaces and for other responsible persons or institutions to observe certain guidelines to ensure prevention of sexual harassment of women. In the case of private employers, the court directed that steps be taken to include the prohibition under the Industrial Employment (Standing Orders) Act. Henceforth sexual harassment, which included unwelcome sexually determined behaviour such as physical contact and advances, a demand or request for sexual favours, sexually coloured remarks, showing pornography and any other unwelcome physical, verbal or non-verbal conduct of a sexual nature, would be regarded as misconduct under the MSO, according to a Labour department release.
