CJ inaugurates fast track court

NIZAMABAD APRIL 24. The Chief Justice of the Andhra Pradesh High Court, Devinder Gupta, has said that interaction among the three wings of the Government is necessary to improve the justice delivery system.

Mr. Justice Gupta was speaking after inaugurating the seventh Additional District Sessions Court building at Bodhan divisional headquarters on Thursday evening. The Bodhan Bar Association raised funds to the tune of Rs. 2.50 lakhs for construction of the new building. This was also the first fast track court constructed and inaugurated outside the district headquarters in Telangana districts.

Mr. Justice Gupta said "it is need less to say that realisation of real justice needs the cooperation of all the three wings of the Government, with one single aim to reach out justice to individuals and thus maintain rule of law.'' He said speedy trial of cases was guaranteed under Article 21 of the Constitution. Setting up of fast track courts was a joint venture of the Central and State Governments and High Courts to tackle the problem of undertrials on a war footing.

He noted that Section 309 of the Criminal Procedure Code mandates trial on day-to-day basis as soon as the examination of the prosecution witness commences. Inconvenience of an advocate is not a `special reason' for by-passing the mandate of Section 309 as had been held by the Supreme Court, he added. He said up to the end of February 2003, 19,412 cases had been transferred to the fast track courts in the State out of which 11,465 had been settled.
