The Bench, comprising Justice B.S.A. Swamy and Justice Yeti Rajulu, were allowing a batch of civil miscellaneous appeals and writ petitions filed by private power generating companies. These companies had entered into agreements with the then APSEB. After the reforms and bifurcation the TRANSCO and the DISCOMS demanded wheeling charges to permit the sale of power by these private companies. The issue was placed before the APERC and it affirmed the wheeling charges. These orders were challenged before the High Court.
