The petitioners challenged the validity of the Karnataka Stamp and Certain Laws (Amendment) Act, 2003, and the Karnataka Court Fee and Suits Valuation Act. The petitioners prayed for striking down the law and for a direction to the State Government to continue vending stamp papers as per the Karnataka Stamp Act and Court Fee and Suits Valuation Act. The petitioners submitted that they were carrying on the business of stamp vending. Prior to the amendment, the fee for court purposes used to be paid by labels and stamp papers. As per the amended the Act, fee amount of up to Rs. 500 could be paid in cash and fees above Rs. 500 had to be remitted to the Treasury. The use of court fee labels and stamp papers had been done away with under the provisions of the new law. The petitioners contended that the State Government lacked the authority to pass the Act. They also contended that the amended Act affected their rights under Article 14, 19, and 21 of the Constitution. N.Kumar, Judge, after hearing the petitioners, passed the interim order and adjourned further hearing of the petition.
