A three-Judge Bench, comprising the Chief Justice, V.N. Khare, Justice Brijesh Kumar and Justice S.B. Sinha, allowed the suit to be withdrawn following a written statement from Andhra Pradesh that the "construction of feeder channel has been stopped''. In an application filed today, Karnataka said the suit prayed for prohibiting Andhra Pradesh from executing the works to transfer and divert 2.5 tmcft of water from Sidagappanakatte to P. Byadagere tank situated in Madakashira taluk, Anantapur district. However, in view of a statement from Andhra Pradesh that construction had been stopped, it might be allowed to withdraw the suit with liberty to institute a fresh suit, if Andhra Pradesh were to take up this project in future. The Bench accepted this and permitted withdrawal of the suit.
